Die litauische Nation, in würdevoller Erinnerung an das glorreiche alte Litauen, haben wieder einen unabhängigen und souveränen Litauischen Staat errichtet und verteidigten diesen  Andenken an ihre Vorfahren mit Hilfe ihrer Streitkräfte und in ihrem unverbrüchlichen Willen, diesen über Jahrhunderte zu schützen, ihre glorreiche Tradition, den Wohlstand und die Macht des Landes sowohl gegenüber den gegenwärtigen wie den zukünftigen Nationen zu sichern.

Unter Berücksichtigung derjenigen Erfahrungen, welche die litauische Nation durch ihre Geschichte und die Vergangenheit ihres Staates erlebt hat, von deren Wiedergeburt und dem Kampf um die Freiheit bis zur Restaurierung und der Dauerhaftigkeit des wieder auferstandenen litauischen Staates, wird Litauen die nachfolgende Verfassung gewährt.

I. Kapitel. Grundsätzliche Bestimmungen.

§ 1. Der Litauische Staat ist ein unabhängiger und souveräner Staat.

Die Souveränität gehört dem Volke.

§ 2. Das Territorium Litauens setzt sich aus Gebieten zusammen, deren Grenzen in den bis jetzt abgeschlossenen internationalen Verträgen beschrieben sind. Es ist unveräußerlich.

§ 3. Der Litauische Staat ist eine Republik.

Der Präsident der Republik ist das Oberhaupt des Staates.

Er regiert den Staat.

§ 4. Die Staatsgewalt ist unteilbar. Sie wird durch den Präsidenten der Republik, der Sejm, die Regierung und das Gericht ausgeübt.

§ 5. Die Staatsorgane üben ihre Funktionen in Übereinstimmung mit dem Prinzip der Billigkeit.

Kein der Verfassung widersprechendes Gesetz hat im Litauischen Staat Gültigkeit.

§ 6. Die Hauptstadt Litauens ist Wilna. Sie darf zeitweilig anderswohin durch ein besonderes Gesetz verlegt werden.

Der § 5 hatte bis Ende 1939 nur eine deklaratorische Bedeutung. Litauens Regierungssitz war seit 1920, seit der Besetzung und nachfolgenden Annexion des Wilna-Gebietes durch Polen, die Stadt Kaunas. Das im § 5 vorgeschriebene Gesetz wurde nicht erlassen. Die Spannungen um das Wilna-Gebiet beschäftigte in dieser Zeit auch des öfteren den Völkerbund; sie gipfelten in der Ansicht Litauens, dass zwischen Polen und Litauen Kriegszustand herrschte. Erst nach der Besetzung Polens durch Deutschland und die Sowjetunion mit Beginn des 2. Weltkrieges wurde das Wilna-Gebiet durch Vertrag zwischen Litauen und der Sowjetunion vom 10. Oktober 1939 an Litauen übergeben.

§ 7. Die Staatssprache ist das Litauische.

Durch Gesetz kann bestimmt werden, in welchen Bezirken Litauens und in welchen öffentlichen Institutionen andere Sprachen neben Litauisch gebraucht werden können.

§ 8. Das Staatswappen ist ein weißer Ritter im roten Feld.

Die Nationalfarben sind: gelb-grün-rot.

Das Staatswappen, die Nationalflagge und die Nutzung dieser werden durch das Gesetz bestimmt.

Die Bezirke und Städte Litauens können eigene Wappen nur aufgrund eines Gesetzes führen.

§ 9. Nationale Feiertage sind:
1. der 16. Februar, in Erinnerung an die Wiederherstellung der litauischen Unabhängigkeit;
2. der 8. September, im Gedenken an die glorreiche Vergangenheit Litauens.

§ 10. Nationale Feiertage, Sonntage und andere Feiertage werden durch den Staat als Tage der Ruhe und der seelischen Einkehr geschützt.

An Feiertagen ist Arbeit nur in den Fällen erlaubt, die das Gesetz bestimmt.

II. Kapitel. Die litauischen Bürger.

§ 11. Die Litauische Staatsbürgerschaft wird durch Geburt, Heirat oder andere Familienzusammenschlüsse sowie durch Option oder Wiedereinbürgerung erworben.

§ 12. Die Litauische Staatsbürgerschaft wird folgenden Personen garantiert:
1. Litauern, die in Litauen wohnhaft sind.
2. Ausländern, die seit mindestens zehn Jahren in Litauen wohnhaft sind.
3. allen, die dem Staat Litauen wertvolle Dienstleistungen erbracht haben.

§ 13. Ein litauischer Staatsbürger, der eine ausländische Staatsbürgerschaft annimmt, verliert die litauische Staatsbürgerschaft.

In gesetzlich festgelegten Fällen kann einem Bürger, der eine ausländische Staatsbürgerschaft angenommen hat, die litauische Staatsbürgerschaft erneut verliehen werden.

§ 14. Ein Bürger, der seit mindestens 2 Jahren nicht mehr in Litauen wohnhaft sind und alle Verbindungen zur Nation abgebrochen hat, verliert die litauische Staatsbürgerschaft.

Die Staatsbürgerschaft wird für Aktivitäten gegen die Sicherheit des Staates entzogen.

§ 15. Die Bedingungen über die Aufnahme und das Verfahren der Wiedereinbürgerung, die Verleihung von Rechten eines litauischen Staatsbürgers und die Entziehung oder der Verlust der Staatsbürgerschaft werden durch Gesetz geregelt.

III. Kapitel. Die Rechte und Pflichten der Staatsbürger.

§ 16. Die Staatsbürger sind Grundlage des Staates.

Der Staat sichert die Freiheit, die Ehre und Gesundheit und schützt das Eigentum der Staatsbürger.

§ 17. Die Staatsbürger genießen das Vorrecht der Freiheit, aber ohne das Recht, die Rechte der anderen zu beeinträchtigen und haben stets auf ihre Pflichten gegenüber dem Staat zu achten.

Die Treue gegenüber dem Staat ist Pflicht eines jeden Staatsbürgers.

§ 18. Alle Staatsbürger sind gleich vor dem Gesetz.

Die Rechte eines Staatsbürgers dürfen wegen seiner Religion oder seiner Abstammung geschmälert werden.

§ 19. Keine Steuer darf erhoben werden, ohne dass das Gesetz eine solche anordnet.

§ 20. Der Staat respektiert die Gewissensfreiheit der Staatsbürger.

Die Staatsbürger sind frei, einer vom Staat anerkannten Kirche oder einer anderen religiösen Gemeinschaft anzugehören oder nicht anzugehören.

Wenn sie sich auf die Beschäftigung von Personen auswirken, haben die Mitglieder von Kongregationen die erforderliche Zeit für die Erfüllung ihrer religiösen Pflichten.

Die Ausübung der verschiedenen Glaubensbekenntnisse und Überzeugungen ist keine Grund dafür, ein Verbrechen zu begehen oder die Erfüllung einer öffentlichen Pflicht zu verweigern.

§ 21. Die Person eines Staatsbürgers ist unantastbar.

Kein Staatsbürger kann vor ein Gericht geladen oder verhaftet werden, außer in den Fällen und in Übereinstimmung mit dem Verfahren, das durch Gesetz bestimmt wird.

Dem verhafteten Bürger ist spätestens 48 Stunden nach der Verhaftung ein Verhaftungsbefehl zuzustellen und der Grund der Verhaftung anzugeben. Erfolgt diese Unterrichtung nicht, ist er sofort freizulassen.

§ 22. Der Staat anerkennt, dass die Wohnung eines Staatsbürgers unverletzlich ist.

Der Staat kann dieses Recht soweit beschränken, als es für die Bekämpfung der Kriminalität durch den Staat erforderlich ist.

§ 23. Der Staat schützt das Korrespondenzgeheimnis zwischen ihren Staatsbürgern.

Der Staat kann dieses Recht durch Kontrollen der Korrespondenz einschränken, soweit dies zur Bekämpfung der Kriminalität notwendig ist.

§ 24. Jeder Staatsbürger hat das Recht, sich frei in jedem Teil des Staatsgebiets niederzulassen und seine Wohnung zu nehmen.

Der Staat kann dieses Recht zur Aufrechterhaltung der öffentlichen Sicherheit einschränken.

§ 25. Der Staat garantiert seinen Staatsbürgern die Freiheit zur Ausübung von gesellschaftlichen Aktivitäten, insbesondere die Presse-, die Vereins- und die Versammlungsfreiheit, soweit diese Aktivitäten nicht im Gegensatz zu den Prinzipien des Staates stehen.

§ 26. Jedem Bürger steht das Petitionsrecht zu.

Dieses Recht wird in Übereinstimmung mit dem gesetzlich festgesetzten Verfahren ausgeübt.

IV. Kapitel. Religion.

§ 27. In its respect for beliefs the State recognises the churches and other confessional organisations at present existing in Lithuania.

Other churches and other confessional organisations may be recognised by the State provided that their principles and their worship are not at variance with public morality and order.

§ 28. The churches and other confessional organisations which are recognised by the State may freely impart their ideas, hold services, have their places of worship and own institutions designed to train for ecclesiastical duties.

§ 29. Orders, associations and fraternities belonging to the churches or other confessional organisations recognised by the State enjoy freedom of action in so far as their activities are confined to teaching religious ideas and performing ceremonies and acts of worship.

§ 30. The churches and other confessional organisations recognised by the State enjoy the rights of corporate bodies. The limits of these rights are defined by law.

§ 31. The clergy of churches recognised by the State may by law be exempted from military service.

§ 32. The teaching of religious dogmas, the performance of ceremonies and acts of worship and the other religious activities of the churches and other confessional organisations recognised by the State and also their places of worship may not be used for a purpose at variance with the constitution and the laws.

§ 33. The situation within the State of churches and other confessional organisations is fixed by agreement or by statute.

V. Kapitel. Kapitel. Familie und Mutterschaft.

§ 34. The unity of the family is the source of the strength of the State.

The State respects, protects and safeguards the family. Large families are held in particular honour.

§ 35. Motherhood is respected, protected and encouraged. The aim of the State in taking action on behalf of mothers, children and young persons is to ensure that the rising generation is healthy in body and strong in mind.

VI. Kapitel. Bildung und Lehre.

§ 36. The chief centres of training and education are the family and the school.

The State also recognises the importance of churches and other confessional organisations as educators.

§ 37. It is the duty of parents to train their children, to imbue them with a love of the fatherland and a determination to sacrifice themselves for their country.

It is the duty of children to respect their parents, to protect them in their old age and to preserve their heritage.

§ 38. With a view to bringing up and educating young persons, the State makes use of educational institutions, schools and youth organisations.

The State takes steps to see that the mental and physical energies of young persons are developed in such a way that they can be made use of in the intellectual and economic life of Lithuania.

§ 39. Citizens in their private capacity and associations. as well as churches or other confessional organisations, are authorised to conduct, on the conditions and in accordance with the provisions laid down by the law, educational institutions and schools.

§ 40. Elementary education is compulsory.

In the elementary schools opened by the State or by local authorities instruction is free.

§ 41. Religious instruction is given in the elementary and secondary schools to the pupils belonging to a church and other confessional organisations recognised by the State. The cases in which religious instruction is given in other schools will be defined by law.

When the number of pupils in a school who belong to a church or confessional organisation is limited, no religious instruction will be given in such schools in the cases provided for by law.

No religious instruction will be given to the pupils belonging to a church or confessional organisation when it is impossible to find the necessary teacher.

§ 42. The State is in charge of training and education and supervises the educational institutions and schools.

§ 43. The purpose of Lithuanian culture and arts is mainly to promote the advance of Lithuania.

The State protects culture and the arts and carefully preserves the relics of the past and other cultural assets.

VII. Kapitel. Arbeit.

§ 44. All labour forms part of the general output and nlust be shown equal respect.

Continuity of labour is the foundation of the State.

The labour resources of the citizen are the wealth of the State.

The citizen is brought up in the love of work and the spirit of profitable activity.

§ 45. The State endeavours to give the labourer and his famIly the benefit of the cultural life of Lithuania.

The State is careful to see that the labourer obtains rest and that this rest is enjoyed under proper conditions.

§ 46. The State arranges for persons who are fit to work to be given employment. The State may compel persons who refuse employment to work.

§ 47. By taking steps to utilise in a suitable and proper manner the working capacity of citizens the State protects and organises labour.

VIII. Kapitel. Nationales Wirtschaftssystem.

§ 48. The task of the national economic system is to ensure the necessary material conditions for the prosperity of the State and the citizen.

§ 49. The prosperity of the national economic system is based on the will of the citizen to produce for his own welfare and that of the State and on the harmonious functioning of labour and capital.

§ 50. The welfare of the State and the citizen can be achieved when the citizen works in an orderly and efficient manner and consumes in moderation.

§ 51. The State protects property.

Property owners must harmonise the use of their property with the needs of the State.

The State may in pursuance of the law expropriate for public utility purposes on payment of compensation.

§ 52. The citizen may offer his labour throughout the whole of the State and accept employment therein as he chooses, as well as choose for himself the site and nature of his economic activities.

The State may by law restrict this right for reasons of public safety.

§ 53. The State makes a point of seeing that agriculture is based on productive properties and that landowners enjoy the necessary conditions and take an active part in a rational system of agriculture.

It is the duty 0f the State to see that industry, commerce and professions are afforded economic openings.

§ 54. The State supports important economic efforts made by citizens and, where necessary, engages in economic activity itself.

§ 55. The State may exact compulsory labour service for reasons of .public utility.

§ 56. While devoting due attention to the structure and the efficient and regular working of the national economic system, the State supervises and controls the activities and organisation of its own establishments.

IX. Kapitel. Gesundheit und soziale Wohlfahrt.

§ 57. The State protects the health of citizens.

§ 58. The State takes care of workers and their families in their old age and in case of accidents.

§ 59. The State supports and reinforces the determination and the efforts of the citizen to earn his own livelihood and that of his family.

The State arranges for citizens who are unable to earn a living for themselves or their families to be assisted.

§ 60. Citizens in their private capacity, associations, churches and other confessional organisations are authorised within the limits of the law to administer charitable institutions.

X. Kapitel. Der Präsident der Republik.

§ 61. Der Präsident der Republik vertritt den litauischen Staat nach außen, akkreditiert die litauischen Gesandten, empfängt die Gesandten der ausländischen Staaten und übt die weiteren, ihm durch die Verfassung und die Gesetze übertragenen Befugnisse aus.

§ 62. Der Präsident der Republik wird für 7 Jahre gewählt.

Er kann wiedergewählt werden.

§ 63. Jeder Staatsbürger, der am Tag der Wahl mindestens 40 Jahre alt und zum Sejm wählbar ist, kann zum Präsidenten der Republik gewählt werden.

§ 64. Der Präsident der Republik wird von Vertretern der Nation gewählt.

Das Gesetz bestimmt, wer zum Vertreter der Nation gewählt werden kann, regelt das Verfahren, wie die Vertreter der Nation gewählt werden und das Verfahren der Wahl des Präsidenten der Republik durch die Vertreter der Nation.

§ 65. Die Person, die zum Präsidenten der Republik gewählt wurde, leistet beim Amtsantritt vor den Vertretern der Nation einen Eid.

Die Eidesformel lautet:
"Vor Gott dem Allmächtigen schwöre ich, dass ich in der Regierung des Staates deren Einheit schützen und in Respekt seiner Ehre und vor der Macht und dem Wohlstand Litauens meine, mir durch die Verfassung übertragenen Befugnisse ausüben werde; ich bin mit der Tatsache bewusst, dass ich hierbei für die Gegenwart und die Zukunft Litauens verantwortlich bin. Mögen die glorreiche Vergangenheit des alten Litauen und der harte Kampf um die Wiederherstellung der Unabhängigkeit mich für diese Aufgaben ermutigen. So wahr mir Gott helfe !"

Der Eid ist vom Präsidenten der Republik und vom Ministerpräsidenten zu unterzeichnen.

Auch wenn der Präsident der Republik wiedergewählt ist, hat er den Eid abzulegen.

§ 66. Die Amtsbefugnisse des Präsidenten der Republik beginnen an dem Tag, an dem er sein Amt antritt.

§ 67. Die Wahl des Präsidenten der Republik ist in den letzten sechs Monaten der Amtszeit des amtierenden Präsidenten der Republik durchzuführen.

Der neu gewählte Präsident der Republik tritt sein Amt an dem Tag an, der dem Tag folgt, an dem sein Vorgänger sein Amt niederlegt, oder wenn an diesem Tag die Wahl des Präsidenten der Republik noch nicht erfolgt ist, der Tag, an dem die Wahl beendet wurde.

§ 68. Wenn der Präsident der Republik stirbt oder zurücktritt, wird sofort nach dem Tod oder dem Rücktritt eine neue Wahl zum Präsidenten der Republik durchgeführt.

Ein so gewählter Präsident der Republik tritt sein Amt an dem Tag an, der dem Tag folgt, an die die Wahl beendet wurde.

§ 69. Wenn die Wahl zum Präsidenten der Republik wegen eines Krieges oder anderer unüberwindlicher Hindernisse nicht oder nicht vollständig durchgeführt werden konnte, wird die Wahl unmittelbar nachdem diese Hindernisse beendet sind, durchgeführt.

Ein so gewählter Präsident der Republik tritt sein Amt an dem Tag an, der dem Tag folgt, an die die Wahl beendet wurde.

§ 70. Bis der gewählte Präsident der Republik sein Staatsamt antritt, regiert der amtierende Präsident der Republik den Staat.

§ 71. Im Falle einer Krankheit oder einer Abwesenheit im Ausland wird der Präsident der Republik vom Ministerpräsidenten vertreten.

Bei der Vertretung durch den Ministerpräsidenten übt dieser die Amtspflichten des Präsidenten der Republik in deren Namen aus.

§ 72. Im Falle des Todes oder des Rücktritts des Präsidenten der Republik übt der Ministerpräsident deren Amtspflichten aus, bis ein neuer Präsident der Republik gewählt ist und sein Amt angetreten hat.

Bei der Vertretung des Präsidenten der Republik hat der Ministerpräsident auch alle Amtsgewalt des letzteren.

§ 73. Der Präsident der Republik ist für die Handlungen im Rahmen seiner Amtspflichten nicht verantwortlich. In Bezug auf seine anderen Handlungen kann der Präsident der Republik nicht angeklagt werden, solange er seine Amtspflichten als Oberhaupt des Staates wahrnimmt.

§ 74. Die Akte des Präsidenten der Republik müssen vom Ministerpräsidenten oder dem zuständigen Minister gegengezeichnet werden.

Die Akte, mit denen der Präsident der Republik den Ministerpräsidenten oder den Staatskontrolleur ernennt oder diese aus ihren Ämtern entlässt oder mit denen er den Ministerpräsidenten oder den Staatskontrolleur wegen eines Vergehens, die mit deren Amtspflichten nicht vereinbar sind, anklagt bedürfen nicht der Gegenzeichnung durch den Premierminister oder eines anderen Ministers.

XI. Kapitel. Der Sejm (Parlament).

§ 75. Der Sejm wird auf fünf Jahre gewählt.

Die Zahl der Abgeordneten und das Verfahren von deren Wahl wird durch das Parlamentswahlgesetz bestimmt.

Die Wahlen zum 4. Seimas fanden noch unter der Verfassung von 1928 am 10. Juni 1936 statt. Dieser Sejm wurde verfassungswidriger Weise durch die, von der Sowjetunion als Besatzungsmacht eingesetzten Regierung am 27. Juni 1940 aufgelöst und durch ein sog. Volksparlament ersetzt, das ohne Gegenkandidaten (was aber verfassungs- und gesetzesgemäß war) im Juli 1940 gewählt wurde. Dieses "Volksparlament" wurde aber nach 1990 nicht mehr als verfassungsmäßiges Parlament angesehen und alle deren Beschlüsse wurden aufgehoben, so dass auch die Verfassung von 1940 und der Beitrittsbeschluss zur Sowjetunion als verfassungswidrig bezeichnet wurden. Das "Volksparlament" wurde ab 25. August 1940 in "Erster Oberster Sowjet der Litauischen Sozialistischen Sowjetrepublik" umbenannt und amtierte bis zur Neuwahl im Februar 1946.

§ 76. Jeder Staatsbürger, der mindestens 30 Jahre alt ist, kann für das Amt eines Abgeordneten des Sejms vorgeschlagen werden.

Das Parlamentswahlgesetz bestimmt, wer Kandidat für das Amt eines Abgeordneten des Sejms werden kann und ordnet das Verfahren der Kandidatenauswahl.

§ 77. Die Kandidaten für den Sejm werden in allgemeinen, direkten, gleichen und geheimen Wahlen gewählt.

Das Wahlsystem ist das proportionale.

§ 78. Jeder Staatsbürger, der das 24. Lebensjahr erreicht hat, ist berechtigt, an der Wahl der Kandidaten des Sejms teilzunehmen.

Jeder Wahlberechtigte ist zur Wahlteilnahme verpflichtet.

Die Wahltage werden vom Präsidenten der Republik bestimmt.

§ 79. Ein gewähltes Sejmmitglied hat einen Eid oder ein feierliches Gelöbnis abzulegen.

Der Eid oder das feierliche Gelöbnis ist in Anwesenheit des Präsidenten der Republik oder des Ministerpräsidenten abzulegen.

Die Eides- oder Gelöbnisformel wird durch das Sejmwahlgesetz festgesetzt.

§ 80. Kein gewähltes Sejmmitglied kann seine Rechte und Pflichten ausüben, solange das Mitglied den Eid oder das feierliche Gelöbnis abgelegt hat.

Ein gewähltes Sejmmitglied, der den Eid oder das feierliche Gelöbnis nicht oder nur unter Bedingungen oder nicht in der vorgeschriebenen Weise und nicht in der gesetzlich festgesetzten Frist abgelegt hat, verliert seine Rechte als Mitglied des Sejm.

§ 81. Mit dem Ablauf von fünf Jahren wird der Sejm durch den Präsidenten der Republik aufgelöst.

Der Präsident der Republik kann den Sejm auch während der fünfjährigen Wahlperiode aufgelöst werden.

§ 82. Die Wahlperiode des Sejms beginnt an dem, vom Präsidenten der Republik bestimmten Tag des ersten Zusammentritts nach der Wahl.

Die Wahlperiode des Sejms endet an dem Tag, fünf Jahre nach dem Tag des ersten Zusammentritts und im Falle der Auflösung während der fünfjährigen Wahlperiode, mit der Auflösung.

§ 83. Können Wahlen zum Sejm wegen eines Krieges oder anderer unüberwindlicher Hindernisse nicht durchgeführt werden, kann der Präsident der Republik die Wahlperiode des Sejms verlängern.

Die so verlängerte Legislaturperiode des Sejms endet mit dem Wegfall der Hindernisse und, im Falle der Auflösung des Sejms mit der Auflösung.

§ 84. Sobald die Legislaturperiode des Sejms abgelaufen ist, wird der Zeitpunkt der Wahlen des Sejms festgelegt, die spätestens sechs Monate nach Ablauf der Periode durchgeführt werden müssen.

Können Wahlen zum Sejm wegen eines Krieges oder eines anderen unüberwindlichen Hindernisses nicht durchgeführt oder fortgesetzt werden, werden diese unmittelbar nach dem Wegfall der genannten Hindernisse durchgeführt.

§ 85. Der Sejm wählt seinen Vorsitzenden und die übrigen Mitglieder des Präsidiums.

Bis der neugewählte Sejm sein Präsidium gewählt hat, werden die Aufgaben des Präsidenten durch einen, vom Präsidenten der Republik oder dem Ministerpräsidenten aus der Mitte der Sejmmitglieder ernannten geschäftsführenden Präsidenten wahrgenommen.

§ 86. Der Sejm entscheidet selbst über die Belange, über die bei seinen Sitzungen debattiert wird. Diese Entscheidung wird als Gesetz verkündet.

§ 87. Der Sejm tritt jährlich für zwei ordentliche Sitzungsperioden zusammen. Die Frühjahrssession beginnt am 15. Februar und endet am 15 April. Die Herbstsession beginnt am 15. September und endet am 30. Dezember.

Die erste Sitzung der ordentlichen Sitzungsperioden eröffnet der Präsident der Republik.

Der Präsident der Republik kann eine ordentliche Sitzungsperiode vor ihrem regulären Ablauf beenden.

§ 88. Der Präsident der Republik kann eine außerordentliche Sitzungsperiode des Parlaments nur aus eigener Initiative einberufen, wenn er auch die zur Debatte vorgelegten Belange festlegt oder wenn drei Fünftel aller Mitglieder des Sejms es verlangen. Dieses Verlangen muss die Angelegenheiten benennen, die der Sejm in der außerordentlichen Sitzungsperiode beraten soll.

Der Präsident der Republik kann dem Sejm während der Sitzungsperiode andere Belange zur Diskussion vorlegen.

Der Präsident der Republik kann eine außerordentliche Sitzungsperiode auch vor der Beendigung der Geschäfte des Sejm schließen.

§ 89. Die Sitzungsperioden des Sejm werden vom Präsidenten der Republik oder vom Ministerpräsidenten im Namen des Präsidenten der Republik eröffnet und geschlossen.

§ 90. Der Sejm kann seine Geschäfte nicht ausüben und keine Beschlüsse annehmen, ohne dass nicht mindestens die Hälfte seiner Mitglieder anwesend sind.

Der Sejm entscheidet durch mündliche Abstimmung.

Der Sejm beschließt durch einfache Mehrheit der anwesenden Mitglieder, solange die Verfassung keine größere Mehrheit vorschreibt.

In Angelegenheiten, bei denen die Verfassung eine größere Mehrheit vorsieht, können nur in Anwesenheit von mindestens der, durch die Verfassung vorgeschriebenen Mehrheit beraten werden.

§ 91. In his parliamentary activities a member of Parliament must make the general welfare of Lithuania his aim and not make it subservient either topersonal or professional interests, regional or special interests or interests of any other kind.

§ 92. A member of Parliament who engages in an occupation incompatible with his duties under the law or who no longer complies with the conditions for membership shall lose the title of member.

§ 93. A member of Parliament is not held responsible far any words spoken by him in the course of a meeting, but if he commits a verbal offence against the safety of the State he rnay be sued in accordance with the usual procedure. Similarly, a member of Parliament shall be responsible for a verbal insult uttered at a meeting of Parliament.

§ 94. A member of Parliament cannot during the session be arrested unless he commits or has committed a crime for which he is liable to a sentence of not less than hard labour; the order for arrest against him shall be submitted to the president of Parliament within 24 hours after the arrest has been made. In other cases a member of Parliament can only be arrested during the session with the agreement of Parliament.

XII. Kapitel. Die Regierung.

§ 95. Die Regierung besteht aus dem Ministerpräsidenten und den Ministern.

Einer der Minister ist der Stellvertreter des Ministerpräsidenten.

§ 96. Der Ministerpräsident überwacht und repräsentiert die Regierung.

Die Minister leiten die Ministerien, die ihnen durch den Staat anvertraut werden.

Die Minister handeln in gegenseitigem Einvernehmen.

§ 97. Der Ministerpräsident und, auf seinen Antrag hin, sein Stellvertreter, und die anderen Minister werden vom Präsidenten der Republik ernannt und entlassen.

Die Entlassung des Ministerpräsidenten schließt diejenige der Minister mit ein.

§ 98. Before beginning to discharge the duties entrusted to them by the President of the Republic, Ministers shall take an oath or make a solemn promise.

The oath and solemn promise shall be taken in the presence of the President of the Republic.

The terms of the oath and the solemn promise shall be defined by the statute of the Council of Ministers.

§ 99. Der Ministerpräsident und die Minister bilden den Ministerrat.

Der Ministerrat übt die Staatsgeschäfte aus und beschließt die hierzu erforderlichen Entscheidungen.

Der Staatskontrolleur nimmt an den Sitzungen des Ministerrates mit beratender Stimme teil.

§ 100. Der Präsident der Republik übernimmt, wenn er anwesend ist, an den Sitzungen des Ministerrates den Vorsitz.

Der Präsident der Republik kann den Ministerrat unmittelbar einberufen.

§ 101. The place of the Prime Minister is taken by his substitute when he is unable to discharge his duties or when he hands them over for a certain time or transfers certain tasks.

§ 102. When the Prime Minister acts for the President of the Republic or takes over control of the State on the death or resignation of the President of the Republic, he no longer acts as Prime Minister. The duties of that office will, during such period, becarried out by his substitute.

§ 103. The Prime Minister or any other Minister may, with the agreement of the President of the Republic, be sued for an offence originating in the discharge of his duties. The case is judged at a meeting of the Supreme Court consisting of at least five judges. The procedure shall be laid down by law.

§ 104. A Council of State prepares and discusses the draft laws and regulations, expresses its views regarding laws and regulations, codifies legislation and discusses other questions.

§ 105. The statute of the Council of Ministers is laid down by law.

XIII. Kapitel. Die Gesetze.

§ 106. Der Verfassung widersprechende Gesetze haben keine Wirkung.

§ 107. Die Gesetzesvorschläge werden während der Beratungen im Seimas betrachtet und von ihm beschlossen.

Sie werden vom Ministerrat oder mindestens einem Viertel der Mitglieder des Parlaments vorgelegt.

§ 108. Ein vom Seimas angenommener Gesetzesvorschlag wird dem Präsidenten der Republik vorgelegt.

The President of the Republic shall approve it and promulgate it or refer it back within 30 days to Parliament for a second discussion, stating the reasons why he has not approved it.

§ 109. If Parliament, after examining the draft law for a second time, accepts it without change by a majority of three-fifths of members, the President shall approve and promulgate such draft law or dissolve Parliament.

If a quarter at least of the members of Parliament recommend the new Parliament at its first session to discuss the same draft law without changes. and if the Parliament by a majority of its members accepts it unchanged, the President of the Republic shall promulgate it as a law.

§ 110. In the absence of Parliament or when it is not in session, laws shall be enacted by the President of the Republic.

§ 111. The procedure for the promulgation and entry into force of laws shall be laid down by a law.

§ 112. The President of the Republic shall delegate full powers for the conclusion of international agreements and shall ratify such agreements.

The Council of Ministers shall recommend Parliament to give its consent to the ratification of agreements which change the laws or require the passing of new laws.

XIV. Kapitel. Das Staatsbudget.

§ 113. The budgetary year begins on 1st January and ends on 31st December.

The budget is drawn up for every budgetary year.

The draft budget is submitted by the Council of Ministers.

§ 114. On 1st November at the latest the Council of Ministers submits the draft budget to Parliament for examination.

During the discussions Parliament may increase the expenditure provided that a law decrees new revenue to defray such expenditure; it cannot decrease the expenditure fixed by law or by agreements.

If by decision of the Council of Ministers a scheme for the creation of an economic undertaking extending over several years has been adopted, and if, in order to make a start with the execution of this scheme, certain amounts are earmarked in the budget, Parliament cannot decrease these amounts which have been inserted by the Council of Ministers in the draft budget for the execution of this scheme.

§ 115. When accepted by Parliament the draft budget shall be laid before the President of the Republic not later than the end of the autumn session.

The President of the Republic is the authority which approves the budget accepted by Parliament.

§ 116. If Parliament does not accept the draft budget at latest by the end of the autumn session and if the President of the Republic does not convene an extraordinary session of Parliament to consider the draft budget,. the Council of Ministers shalI submit it for approval to the President of the Republic.

§ 117. In the absence of Parliament the Council of Ministers shall refer the draft budget to the President of the Republic for approval.

§ 118. The President of the Republic shalI approve the draft budget and promulgate it as it stands. .

If the budget is not promulgated by the end of the budgetary year at the latest, pending its promulgation, expenditure may be incurred in accordance with the provisions of legislation.

§ 119. The budget may be amended.

The budget shall be amended in accordance with the procedure laid down for framing, accepting and approving the draft budget. Nevertheless, in the absence of Parliament or if it is not in session, the Council of Ministers may submit the amended budget to the President of the Republic for approval.

XV. Kapitel. Anfragen und Interpellationen.

§ 120. Any member of Parliament may put questions to the Prime Minister or any Minister.

§ 121. At the request of one-fourth of its members, Parliament may interpellate the Prime Minister or any Minister.

§ 122. After hearing the reply of the Prime Minister or the Minister to whom a question has been put, and at the request of one-fourth of its members, Parliament may by a majority of three-fifths of its members declare that it does not regard the reply as satisfactory.

If Parliament finds the reply of the Prime Minister inadequate the Prime Minister shall resign or Parliament shall be dissolved.

If Parliament takes the same attitude towards the reply of a Minister, the latter shall resign. If, however, before Parliament's decision regarding the reply of the Minister interpellated, the Prime Minister declares that he agrees with that Minister's reply, the question put to the Minister shall be deemed to have been addressed to the Prime Minister.

If at the first session of a newly elected Parliament at least one-fourth of the members propose to discuss the same interpellation which led to Parliament being dissolved and if Parliament by a simple majority decides to regard the reply given to the interpellation as unsatisfactory, the President of the Republic shall dismiss the Prime Minister from his office.

XVI. Kapitel. Staatliche Verwaltungsorganisation.

§ 123. The Ministries conduct the departments which fall within the purview of the State.

For the purposes of such administration the territory of the State is divided into territorial administrative units.

The organisation of Ministries is laid down by law.

§ 124. The President of the Republic appoints and dismisses the officials and other employees whose appointment and discharge are vested in him by law.

The organisation of the service of officials and other employees is determined by law.

§ 125. Records of births, marriages and deaths are drawn up by the State authorities in accordance with the procedure and on the conditions laid down by law.

Persons who are members of a religious denomination may have such records drawn up by their own Ministers on the conditions and in accordance with the procedure laid down by law; they are not obliged to have them drawn up again elsewhere.

§ 126. Regional administrations shall be organised to serve regional requirements.

Economic and industrial activities may be conducted by Veikmenines (Konzern aus Unternehmen zur Herstellung, zum Import und Export, die unter staatlicher Aufsicht stehen).

§ 127. The right of exercising certain local powers on independent or autonomous lines may be granted to special areas of Lithuania.

The right to autonomous government sha.ll be granted in pursuance of a statute laid down by law. The law shall also determine the powers and the conditions for the administration of estates of local importance.

§ 128. In order that the activity of administrative organs should achieve its purpose and remain equitable, it will be supervised by the supreme organs in the manner laid down by law.

The law shall determine in what cases the activity of the organs of administration shall also be supervised by judicial institutions.

XVII. Kapitel. Justiz.

§ 129. Justice shall be rendered by the Judiciary. The judiciary shall exercise its functions independently.

The judiciary shall render justice in the name of the Republic of Lithuania.

A decision of the judicial authorities can only be altered or annulled in accordance with the law.

§ 130. The President of the Republic may remit, wholly or in part, or convert into a lighter sentence, a penalty imposed under a decision of the judicial authorities.

In the cases fixed by law the President of the Republic may restore the privileges withdrawn or diminished by the judiciary.

§ 131. The Supreme Court constitutes the single and supreme jurisdiction for the whole territory of the State.

§ 132. The courts are set up by law.

Their organisation and procedure are determined by law.

XVIII. Kapitel. Die nationale Verteidigung.

§ 133. The defence of the State is incumbent upon all citizens.

The army is the basis of national defence.

§ 134. Citizens are trained for the defence of the State as need requires.

The national economic system is adjusted to the requirements of national defence.

§ 135. The President of the Republic is the supreme head of the armed forces.

The formation of the armed forces is laid down by law, as are the organisation and powers of the military authorities.

§ 136. The President of the Republic appoints and dismisses the head of the army.

The head of the army cannot be sued for an offence originating in the exercise of his office except with the agreement of the President of the Republic.

§ 137. To decide on questions affecting national defence a National Defence Council is set up and attached to the President of the Republic.

The membership and powers of this council shall be determined by law.

§ 138. When the State is being defended, national defence shall be regulated by decrees of the President of the Republic which have the force of law. Nevertheless, during such a period, the laws governing national defence shall remain in force until they are amended by decrees of the President of the Republic.

The decrees of the President of the Republic must be countersigned by the Prime Minister.

§ 139. A state of war may be decreed in the State generally or in one area when there is danger to public order or the safety of the State; it is a period during which the State is subject to increased protection or is in a state of defence.

The President of the Republic, on the proposal of the Council of Ministers, decrees and abolishes the state of war.

§ 140. The law on the state of war gives power to restrict or abolish the rights mentioned in the chapter on the rights and duties of citizens with the exception of the right specified in article 20, to use extraordinary means for the defence of the State and to impose extraordinary obligations on the population.

Under the law extraordinary courts may be set up when a state of war is in force.

§ 141. The President of the Republic, on the proposal of the Council of Ministers, decides questions of mobilisation, war and peace.

If Parliament is in session, its agreement is necessary for a decision on peace.

§ 142. Members of the forces on active service, and their civilian accomplices, shall be judged by the military courts in the event of offences having been committed.

§ 143. The State protects and assumes responsibility for members of the forces whose health has suffered during service, and also the families of members of the forces whose health has suffered or who have died in the course of their service.

In the cases laid down by law the State assumes responsibility for citizens who, when engaged in the defence of the State, have sustained damage to their health and also for families of citizens who have died while engaged in the defence of the State.

XIX. Kapitel. Die Staatskontrolle.

§ 144. The State Controller is in charge of the control of the State.

The State Controller is appointed and dismissed by the President of the Republic.

§ 145. On taking up office the State Controller takes an oath or gives a solemn promise.

The oath and the promise are given in the presence of the President of the Republic.

The terms of the oath and the solemn promise shall be laid down by the law on the control of the State.

§ 146. The State Controller sees that the State Treasury is administered according to the law.

In the cases specified by law he gives his opinion as to the expediency of agreements. Differences of opinion between the State Controller and a Minister as to the advisability of an agreement shall be settled in the Council of Ministers.

§ 147. The State Controller sees that legality is respected in giving effect to the budget of the State.

Complaints regarding deductions shall be decided in accordance with the procedure laid down by law.

§ 148. The State Controller prepares an annual report on the use made of funds and submits it to Parliament for approval, and, if Parliament is not in session to the President of the Republic for his approval.

§ 149. By law the State Controller may be instructed to see that legality is respected in the administration of the property and in the use made of the funds of local administrations and Veikmenines and in the administration of those institutions or establishments which are included in the budget of the State or which are in receipt of subsidies.

§ 150. The State Controller may be sued in court and sentenced for an offence originating in the exercise of his duties in accordance with the procedure laid down for the prosecution and sentence of a Minister for an offence committed in the discharge of his duties.

§ 151. The control of the State is detailed by law.

XX. Kapitel. Verfassungsänderungen.

§ 152. A draft amendment to the constitution may be proposed by the Council of Ministers or by at least one half of the members of Parliament.

The draft amendment to the constitution shall be discussed by Parliament.

§ 153. Parliament shall vote for the draft amendment to the constitution by a majority of at least three-fifths of its members.

The draft amendment to the constitution when accepted by Parliament shall be laid before the President of the Republic.

§ 154. The President of the Republic shall approve and promulgate as the constitution the draft amendment to the constitution or else dissolve Parliament.

If at the first session of the newly elected Parliament half at least of its members propose to accept unchanged the same draft amendment to the constitution and if Parliament thus accepts it bya majority of at least three-fifths of its members, the President of the Republic shall promulgate it as the constitution.

XXI. Kapitel. Schlußbestimmungen.

§ 155. On the entry into force of the present constitution the constitution of the State of Lithuania now in force shall cease to be applied.

§ 156. The laws existing before the entry into force of the present constitution which are not at variance therewith and have neither been amended nor abrogated under its provisions shall remain in force.

Autoritäre Verfassung, die von dem 1936 gewählten Sejm verabschiedet wurde. Zur Wahl war nur eine Partei zugelassen. Die Verfassung festigte die Präsidentendiktatur und galt, formal bis zur Verabschiedung der Verfassung von 1992.
